By downloading, accessing, or using the Garden AI mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms apply to all users of the App.

2Description of Service

Garden AI is an AI-powered plant identification application that provides:

✓Plant Identification: AI-powered recognition of 20,000+ plant species from photos
✓Care Guides: Personalized watering, sunlight, and care recommendations
✓Disease Diagnosis: AI analysis of plant health issues
✓Reminders: Automated watering and care notifications

We reserve the right to modify, suspend, or discontinue any part of the App at any time without notice.

3User Accounts

3.1 Account Creation (Optional)

You may use basic features without an account. To access premium features or sync data across devices, you may create an account. You must provide accurate and complete information.

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

4Acceptable Use Policy

You agree NOT to:

✗Use the App for any illegal or unauthorized purpose
✗Reverse engineer, decompile, or disassemble the App
✗Transmit viruses, malware, or harmful code
✗Attempt to gain unauthorized access to our systems
✗Use automated scripts to collect data from the App
✗Impersonate any person or entity

5Intellectual Property Rights

5.1 Our Property

The App, including its code, design, graphics, database, and AI models, is owned by Garden AI and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the App without our written permission.

5.2 Your Content

You retain ownership of photos you upload. By using the App, you grant us a limited license to process your photos for plant identification purposes. Photos are deleted after processing unless you save them to your collection.

•Medical/Safety Advice: The App does NOT provide medical or safety advice. Do not consume plants based on App identification. Consult professionals before handling potentially toxic plants.
•Availability: We do not guarantee uninterrupted or error-free service.

7Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GARDEN AI SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages resulting from misidentification of plants
• Health issues arising from plant handling based on App advice
• Damages exceeding the amount paid to us (if any) in the past 12 months

8Subscriptions & Payments

8.1 Free Tier

Basic plant identification is free with unlimited scans. Premium features may require a subscription.

8.2 Premium Subscriptions

Auto-Renewal: Subscriptions automatically renew unless canceled

Cancellation: Cancel anytime through your device's subscription settings (App Store or Google Play)

Refunds: Managed by Apple App Store or Google Play Store according to their policies

Price Changes: We may change subscription prices with 30 days' notice

9Termination

We may suspend or terminate your access to the App at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Excessive abuse of the service
• At our sole discretion for any reason

You may delete your account at any time through the App settings.

10Governing Law & Disputes

These Terms are governed by the laws of [Your Jurisdiction]. Any disputes shall be resolved through binding arbitration, except where prohibited by law.

You waive the right to participate in class action lawsuits or class-wide arbitration.
